This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and 1x1 Corp ("Licensor," "we," "us," or "our") for the use of the Horizon mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.
1x1 Corp grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal and commercial purposes, subject to the terms and conditions set forth in this Agreement.
You agree not to:
Modify, adapt, translate, or create derivative works based on the App.
Reverse engineer, decompile, disassemble, or attempt to discover the source code of the App.
Remove, alter, or obscure any proprietary notices or labels on the App.
Use the App for any purpose that is illegal or prohibited by this Agreement.
Conduct any security testing, except for white hat security researchers who may identify and report issues.
All intellectual property rights in and to the App, including but not limited to copyrights, patents, trademarks, and trade secrets, are owned by 1x1 Corp. This Agreement does not grant you any rights to such intellectual property except for the limited license granted herein.
The App may allow you to submit, upload, or otherwise make available content, including but not limited to text, photos, and videos ("User Content"). You retain ownership of any User Content you provide. By submitting User Content, you grant 1x1 Corp a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and 1x1 Corp's business, including for AI training purposes.
The App includes a content moderation system where keywords or phrases identified as inappropriate by users are replaced with an asterisk. Users can vote on the appropriateness of content. If more than 50% of the votes favor blocking a keyword or phrase, it will be replaced with an asterisk in the App.
Your use of the App is also governed by our Privacy Policy, which can be found at https://1x1.dev/policies/privacy-policy. By using the App, you consent to the practices described in the Privacy Policy.
This Agreement is effective until terminated by either party. Your rights under this Agreement will terminate automatically without notice from 1x1 Corp if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the App and delete all copies of the App from your device.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 1x1 Corp does not warrant that the App will be uninterrupted or error-free.
To the maximum extent permitted by applicable law, 1x1 Corp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your use or inability to use the App;
Any unauthorized access to or use of our servers and/or any personal information stored therein;
Any interruption or cessation of transmission to or from the App;
Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party;
Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
This Agreement constitutes the entire agreement between you and 1x1 Corp concerning the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
